BiH Court - Marko Jurleta sentenced to one year in prison for tax evasion

SARAJEVO, March 6 (FENA) - Upon examination and acceptance of a guilty plea agreement, the Court of Bosnia and Herzegovina delivered a judgment on 5 March 2018, finding the accused Marko Jurleta guilty of the criminal offense of Tax Evasion or Fraud under Article 210 paragraph 4 as read with paragraph 1, all in conjunction with Article 31 and 54 of the CC of BIH.

The Court sentenced the Accused Marko Jurleta  to one (1) year in prison  and as an accessory punishment pronounced an a fine in the amount of BAM 10.000,00 which the Accused has to pay within thirty (30) days from the day the Verdict becomes final and binding. In case the Accused fails to pay the fine in the said deadline, pursuant to Article 47(3) of the CC of BIH, the Court shall replace it with prison sentence in as much as one day in prison shall count for each BAM 100, without exceeding the sentence prescribed for that offense. 

The Accused Marko Jurleta is found guilty because in the period of November 2009 to August 2011 as an actual employee of the legal entity  „J“ d.o.o. Gornji Vakuf/Uskoplje in the sales department (procurement-sales), acting upon the instructions of Branko Zeko, director and responsible person in the legal entity „J“ d.o.o. Gornji Vakuf-Uskoplje, on several occasions organized the reception, unloading and sales of coffee which crossed the border without being registered - smuggled into Bosnia and Herzegovina during which time the Accused Marko Jurleta, upon a previous agreement with Robert Duno, directly negotiated with an Austrian supplier about the procurement of coffee for the legal entity  „J“ d.o.o. Gornji Vakuf/Uskoplje and for its invoicing by the supplier although he knew that such turnover is fictitious for other legal entities and in the course of 2011 until late August for the legal entity  Ugljar Vienna.

Pursuant to Article 188(1) of the Criminal Procedure Code of BIH, the Accused is ordered to reimburse the costs of the criminal proceedings in the amount of BAM 1,444,64.00 within thirty (30) days from the day the Verdict becomes final, subject to coercive collection, stated the BiH Court.
