Ambassadors in BiH: Urgently adopt amendments to CPC and Law on OSA

SARAJEVO, March 15 (FENA) - Embassies of France, Italy, the Netherlands, Germany, the United States of America, Spain and the United Kingdom to Bosnia and Herzegovina are deeply concerned about the inability of BiH authorities to reach an agreement and adopt a set of amendments to the Criminal Procedure Code (CPC) and the Law on OSA, which was recently emphasized in the statements by the Delegation of the European Union and the OSCE.

By a decision of June 2017, the BiH Constitutional Court gave the authorities responsible for this matter six months to reach an agreement and adopt amendments to both laws.

“Amendments should fully meet the requirements of the Constitutional Court decision and preserve the integrity and independence of security and justice institutions at the state level, within their existing legal competencies. We note that the proposal currently being considered by the BiH Parliamentary Assembly meets these requirements,” reads a joint statement by the ambassadors of the said countries.

They emphasize that partial solutions that are not in accordance with international standards and failure to implement the amendments would result in the BiH Prosecutor's Office and the BiH Security Agency being unable to effectively fight organized crime and terrorism.

They also warn that the lack of timely agreement and the failure to adopt adequate legislation would be a reckless act and that in the world that is connected, such an act would endanger not only the security of BiH but also the security of regional and international partners of BiH.

“So far, the Justice Ministry has not proposed appropriate amendments to the Criminal Procedure Code that would be in line with international standards. This issue must be solved urgently. We call on Minister Josip Grubeša to fulfill his duty by urgently proposing amendments to the CPC in accordance with international standards,” the ambassadors of France, Italy, the Netherlands, Germany, the United States of America, Spain and the United Kingdom to BiH said in a statement.

They urge the Council of Ministers and the BiH Parliamentary Assembly to adopt amendments that are in accordance with international standards on both laws without delay, before the next session of the BiH Constitutional Court scheduled for March 22.
