Stricter rules and higher penalties in field of personal data protection

SARAJEVO, May 10 (FENA) - One of the main goals of the conference "Application and Challenges of New EU Legislation in the Field of Personal Data Protection with a Focus on BiH" is to present to the BiH public the provisions of the European Union (EU) General Data Protection Regulation (GDPR), which will begin to be directly applied in EU countries from 25 May.

The conference, which is being held today in Sarajevo, was jointly organized by the Foreign Investors Council of Bosnia and Herzegovina and the company Wolf Theiss and Microsoft BiH.

The General Data Protection Regulation is one of the most important international regulations in the field of personal data protection.

The territorial validity of this act has been extended, so the Regulation also applies to the processing of personal data of people who are not in the EU.

In addition, as explained by lawyer and team leader of the ICT Working Group at the Foreign Investors Council, Lana Sarajlić, this Regulation is important for business entities in BiH and because BiH has the obligation to harmonize its legislation with EU law or the GDPR, which is currently in progress.

She noted that the GDPR introduced several new things, envisaged stricter rules of application and higher standards for the protection of personal data.

She particularly stressed that the penal policy would be very strict and that various types of penalties, including money, were provided, which could amount to up to four percent of the annual turnover of the company or 20 million euros, depending on which amount is higher.

The drafting of a new Law on the Protection of Personal Data in BiH is underway, which should be in line with the Regulation, while Assistant Director of the BiH Personal Data Protection Agency, Samira Čampara, said that the Proposal of the new law prepared by the Agency would soon be completed.
