Ekrem Ibračević sentenced to 3 years in prison for war crime in Srebrenik

SARAJEVO, May 11 (FENA) - On 11 May 2018, the Panel of Section I for War Crimes at the Appellate Division of the Court of Bosnia and Herzegovina delivered a judgment finding the accused Ekrem Ibračević guilty that by the actions described in Sections 1, 2 and 3 of the Operative Part of the Judgment he committed the criminal offense of War Crimes against Civilians under Article 142(1) of the Criminal Code of the Socialist Federative Republic of Yugoslavia (CC SFRY), which was adopted pursuant to the Law on the Application of the Criminal Code of the Republic of Bosnia and Herzegovina and the Criminal Code of SFRY, in relation to Subparagraphs 1 and 3, and as read with Article 22 of the same Code, for which he was sentenced to 3 (three) years of imprisonment.

The accused Ekrem Ibračević was found guilty that between early June 1992 and late August 1992, during the war and armed conflict in Bosnia and Herzegovina between the military and police forces of the Republic of Bosnia and Herzegovina and military and police forces of the Serb Republic of Bosnia and Herzegovina in the territory of villages Tinja, Potpeć, Jasenica and other villages in the Srebrenik municipality, as well as the village of Brezje and other villages in the Lopare municipality, as Head of Military Security at the Srebrenik Municipal Territorial Defense Staff, at the detention facilities of Rapatnica, located on the premises of the Rapatnica local community building, in Rapatnica, Municipality of Srebrenik, and Luke, located on the premises of the local football club Rapatnica in Luke, Municipality of Srebrenik, which were used for unlawful detention of Serb civilians, he acted in violation of common Article 3(1)c) of the Geneva Conventions of 12 August 1949.

Pursuant to Article 188(4) of the Criminal Procedure Code of Bosnia and Herzegovina, the accused Ekrem Ibračević is relieved of the obligation to reimburse the costs of criminal proceedings, stated the BiH Court.
