BiH PA House of Peoples adopts amendments to the Criminal Procedure Code

SARAJEVO, September 11(FENA) - Deputies of the House of Peoples of the Parliamentary Assembly of Bosnia and Herzegovina (BiH PA) today unanimously passed the amendments to the Criminal Procedure Code of BiH, proposed by a deputy Halid Genjac (SDA).

Members of the Constitutional-Legal Committee of the House of Peoples previously supported several amendments, while at the same time they have established compliance with the Constitution and the legal system of BiH with amendments to the law, which was previously adopted by the BiH PA House of Representatives.

Deputies from the Croat people from HDZ Ljilja Zovko, Bariša Čolak, Zdenka Džambas and Mario Karamatić (HSS) withdrew their bill, because there was a situation in which three proposals of amendments to the same law were before the deputies.

Genjac explained that, should his proposal be accepted, another session of the House of Representatives needs to be held in order to adopt the Law in the same text, and in this case the House of the People would not be obliged to review the Amendment to the Law previously supported by the House of Representatives.

“However, if amendments to the law were to be adopted without those changes supported by the House of Representatives, then it would be necessary to establish a committee for harmonizing the text of the Law for both Houses and to organize two more sessions of the House of Representatives,” added Genjac.

The law needs to be changed in order to comply with the decision of the Constitutional Court, which declared unconstitutional the certain provisions of the Law, but also because of the standards of the European Commission, and to preserve the integrity of the judicial system in the fight against organized crime and corruption, especially against international crime.

The House of Peoples also adopted a conclusion requesting the House of Representatives to review these amendments in urgent procedure.

After passing this law, the House rejected the Draft Law on Amendments to the Criminal Procedure Code of Bosnia and Herzegovina proposed by the House of Representatives of the Parliamentary Assembly of BiH.
