Law on Public Procurement in BiH inadequately implemented in tender procedures

SARAJEVO, October 3 (FENA) - The monitoring of public procurement in BiH, conducted by four non-governmental organizations showed that the Public Procurement Law treats this area inadequately, especially from the point of view of protecting the public interest, it was stressed today at today's press conference in Sarajevo by the participants of the conference the Open Society Fund in BiH, EDA Development Agency, Transparency International BiH, the Center for Investigative Journalism and the citizens' association "Tender".

They say that there is a clear lack of well-trained public procurement officers, and they also realized that the deadlines for certain types of procurement procedures are very short, ranging from two to four days.

In this short period of time, as they underline, it is completely impossible even to read the entire documentation, let alone properly complete the entire public procurement procedure.

The monitors also noted a number of problems, among which were insufficient competitiveness, a small number of offers per announced tenders, as well as favoring the same suppliers again and again.

“The basic method of identifying the supplier is the ratio of the total revenues of the supplier and the revenues deriving from the public procurement contract. A special focus is on the suppliers whose ratio of revenues from public procurement is larger in their total revenues,” they explained.  

As a positive fact, they pointed out that compared to the previous year, in 2018, there was more transparency regarding the availability of public procurement, that is, the number of announcements on the public procurement websites have increased, primarily in the field of construction works which, according to the monitors, is the most frequent segment where corruption and money laundering takes place.
