Komšić: The CEC decision blatantly violates the Constitution of FBiH

SARAJEVO, December 18 (FENA) - Member of the Presidency of Bosnia and Herzegovina, Željko Komšić, reacted after the decision of the Central Election Commission to use the 2013 census for the composition of the House of Peoples of the Parliament of the FBiH and stressed that he would appeal against such decision to the Appellate Division of the Court of Bosnia and Herzegovina.

Komšić stated that such a decision of the CEC blatantly violates the FBiH Constitution, more precisely, amendment 51 of the Constitution of the Federation of BiH.

The said amendment clearly stipulates, as Komšić underlines, that the1991 census results will be used for all calculations that require demographic data, as long as Annex 7 of the Dayton Peace Agreement has not been fully implemented.

“Given that Annex 7 has not been implemented and this can be ruled only by, either the Parliamentary Assembly of BiH or the High Representative in BiH, this decision of the CEC represents a flagrant violation of the FBiH Constitution.
