BiH Constitutional Court of BiH tomorrow to deliberate on CEC instruction

SARAJEVO, January 30 (FENA) - The Constitutional Court of Bosnia and Herzegovina, at a plenary session scheduled for tomorrow, should consider the request for review of the constitutionality of the BiH Central Election Commission (CEC BiH) guidelines on the manner of allocating the mandates in  the House of Peoples of the Parliament of the Federation of BiH.

The request of 27 deputies of the House of Representatives of the Parliament of the Federation of Bosnia and Herzegovina to review the constitutionality of the Instructions to the Amendments to the Instructions on the procedure for the implementation of indirect elections for the authorities in Bosnia and Herzegovina covered by the Election Law of BiH, is also on the agenda of the session of the Constitutional Court of BiH.

This request challenges the act adopted by CEC BiH on December 18 last year, which stipulates that the 2013 census would be used for the formation of the House of Peoples of the FBiH Parliament and the principle 1/1/1 which implies that there will be at least one Bosniak, one Serb and one Croat from each canton in the House of Peoples, if they are elected.

The media reported that the CEC guideline has triggered a heated reaction from the representatives of a number of political parties in BiH, citing that the Constitution of the Federation of Bosnia and Herzegovina clearly states that only the 1991 census can be used in the mentioned process and consider that the challenged act (CEC instruction) divides the state into three ethnic units.

As FENA learns in the Constitutional Court of BiH, the court also received the request of the Chairperson of the House of Representatives of the Parliamentary Assembly of Bosnia and Herzegovina Borjana Krišto to review the constitutionality of the CEC instruction.

Meanwhile, CEC BiH has submitted to the Constitutional Court a statement regarding the adopted / contested act on the completion of the constitution of the House of Peoples of the FBiH Parliament.
