Verdict of acquittal in Mile Puljić case, charged with war crime, revoked

SARAJEVO, February 8 (FENA) - In the criminal case against the accused Mile Puljić charged with the criminal offense of Crimes against Humanity punishable under Article 172 Paragraph 1 Subparagraphs (h), (i) and (k) in conjunction with Article 180 Paragraphs 1 and 2 of the Criminal Code of  Bosnia and Herzegovina (CC BiH), all in conjunction with Article 29 of the CC BiH, Panel of Section I for War Crimes of the Appellate Division of the Court of Bosnia and Herzegovina (BiH), having held a session, issued a Decision granting the appeal of the Prosecutor's Office of BiH, revoking the Judgment of the Court of BiH no. S1 1 K 017799 15 Kri of 16 May 2018 and ordering that a trial be held before Panel of Section I for War Crimes of the Appellate Division of the Court of BiH.

Under the First-Instance Judgment, the accused Mile Puljić was acquitted of the charges.

The Prosecutor's Office of BiH filed an appeal against the First-Instance Judgment acquitting the accused Mile Puljić of the charge within the set limit on the grounds of essential violations of the provisions of criminal procedure, violation of the Criminal Code and error of fact, petitioning a Panel of the Appellate Division to grant the appeal and reverse the impugned judgment by finding the accused guilty.

Alternatively, the Prosecutor's Office of BiH petitioned that the First-Instance Judgment be revoked and a trial held before the Appellate Division Panel.

Counsel for the accused submitted a response to the appeal of the Prosecutor's Office of BiH within the set limit, petitioning the Court to dismiss the appeal as ill-founded and uphold the First-Instance Judgment.

At a session of the Appellate Panel held on 18 January 2018, in accordance with Article 304 of the Criminal Procedure Code of BiH, the Prosecutor gave a brief account of the arguments and stated that she maintained the arguments in their entirety.

Furthermore, defense counsel gave a brief account of the response to the appeal of the Prosecutor's Office of BiH, petitioning the Appellate Panel to dismiss the appeal of the Prosecutor's Office of BiH as ill-founded and uphold the First-Instance Judgment. The accused joined the submissions of his counsel, stated the BiH Court.
