BiH Ombudspersons: Violation of human rights in BiH is at systemic level

SARAJEVO, March 18 (FENA) - Analyses of the Institution of the Ombudsman for Human Rights of Bosnia and Herzegovina have shown that there is a systemic violation of human rights in BiH. The institution is indisputably indicated the complicated way of reporting and fighting for the protection of the rights of vulnerable categories of the population.

As it was noted during today's presentation of the annual report of the work of this institution, the largest number of citizens' complaints last year related to the length of the trial, and Human Rights Ombudsperson Nives Jukić singled out an example of the complainant who has been waiting for the execution of the verdict in his case since 2013.

She explained that this is a person who is retired today, and the person sought his rights are from labor law relations and she recommended on this occasion that the amount of budget funds be increased at all levels of government in order to implement the final decisions of courts.

There is an increasing number of complaints related to healthcare, but also the number of complaints from citizens in the field of public utility services, while the number of complaints in the field of social protection does not reflect the real state of affairs, bearing in mind the fact that social welfare is merely symbolic and cannot provide for basic living needs.

The ombudsman institution warned about a large number of reports on violations of the rights of children who are victims of peer violence or domestic violence, and most of the complaints relate to the lack of a system in complicated and messy divorce cases.

When it comes to complaints based on discrimination, Jukić emphasized that an increase in the number of such complaints was recorded last year, but estimates that discrimination is much more present than can be demonstrated in this way because citizens are afraid to report it.

Jukić also singled about a worrisome increase in the number of complaints pointing to the inappropriate content of published on social networks containing hate speech and discrimination on various grounds.

“However, in the past year, we had a large number of cases that were resolved positively after the first address to the institution because the responsible party eliminated the causes that led to discrimination,” concluded Jukić.

Jasminka Džumhur, BiH Ombudsperson, pointed out that another issue is also problematic, saying that it is necessary for the citizens to address the courts for the protection of their rights, but she worries that it is futile since the recommendations of this institution in Bosnia and Herzegovina are not being implemented, as the state also refuses to implement the judgments of the European Court of Human Rights.

“Complaints filed with the Ombudsman Institution indicate that the institutions of the system are often part of the problem. Instead of removing obstacles they often add another problem to the situation. It is difficult to maintain the principles of the rule of law and human rights protection in BiH while it is done only by a few professionals in the institutions,” she explained.

More than a hundred complaints last year citizens filed against the work of police authorities, most of them involving excessive use of force, and it was further emphasized that as much as 44 of their recommendations have not produced any response from the institutions.
