Komšić: Prior to anything else, BiH must implement all ECHR judgments

SARAJEVO, May 20 (FENA) - Bosnia and Herzegovina, in the course of its efforts to join the European Union, has to fulfill all the obligations put forth in the European acquis in the coming period, thus ensuring the maximum protection of individual human rights and fundamental freedoms, since the equality of all citizens and the protection of their individual human rights, are the unavoidable foundations of the European Union,” said a member of the Presidency of Bosnia and Herzegovina, Željko Komšić today in a statement for FENA.

He recalled that, precisely the European Convention for the Protection of Human Rights and Fundamental Freedoms, as defined in Article II / 2 and II / 4 is a part of the Constitution of Bosnia and Herzegovina, as an act that has priority over all domestic laws, which certainly includes the Election Law of Bosnia and Herzegovina.

Komšić emphasizes that the fulfillment of these obligations in the context of respecting the basic European principles and standards implies the implementation of four previous judgments of the European Court of Human Rights in Strasbourg: Sejdic-Finci, Zornić, Pilav and Šlaku.

“These judgments have determined the existence of systemic discrimination in the Constitution of Bosnia and Herzegovina, thus creating an obligation for our country to correct it,” said Komšić, stressing that this remains an international obligation of BiH.

Komšić also underlines that it is not possible to amend the Election Law of Bosnia and Herzegovina taking into account only the decisions of the Constitutional Court of Bosnia and Herzegovina, but for the purpose of EU and NATO integration, we will have to implement the judgments of the European Court of Human Rights in Strasbourg, as well as those that are part of the European acquis communautaire that refer to protection individual rights of all citizens.

“Without that, the candidate status for Bosnia and Herzegovina will become very questionable, as will its overall European perspective. This will become clearer when the European Commission publishes its opinion on the possible candidate status for Bosnia and Herzegovina, as well as its recommendations and measures, that is, the obligations that Bosnia and Herzegovina will have to fulfill on its European path,” says Komšić.

He added that all political stakeholders who make proposals that are contrary to the European acquis, European values ​​and norms, will then have the opportunity to correct their own views or, otherwise, to completely relinquish the European aspirations of Bosnia and Herzegovina by choosing to follow other, anti-civilization policies that completely distance Bosnia and Herzegovina from the European Union.
