Komšić: Citizens and the international community have no confidence in HJPC

SARAJEVO, June 10 (FENA) - Member of the Presidency of Bosnia and Herzegovina Željko Komšić, responding to a letter sent by the Vice-President of the High Judicial and Prosecutorial Council (HJPC) Ružica Jukić, welcomed the return of the international community's focus on the rule of law, functioning and independence of the judiciary Bosnia and Herzegovina.

“I do not consider this interest as a pressure on the institutions of Bosnia and Herzegovina, but as an aid in establishing the independence of the judiciary and isolating the individuals who abuse these institutions,” said Komšić.

Komšić also noted that since the establishment of the High Judicial and Prosecutorial Council and the launching of a structural dialogue on the judiciary by the European Union due to dissatisfaction with the then judicial system, this period of ten years has obviously been exploited in a way for the domestic political elites to take over the entire judicial system.

“Jukić did not say a single word about this detail. so it can be freely concluded that it is a problem for the HJPC only when the international community in BiH shows dissatisfaction with their work, but when it comes to continued political influence on their work, obviously Jukić is perfectly fine with that,” underlined Komšić.

He believes that it is merely enough to review who was the loudest speaker against the judicial system in BiH in the period since the establishment of the HJPC from 2004 and the beginning of the structural dialogue in 2011, and who is defending it today by using all the political and media influences.

“When the structural dialogue on the reform of the judiciary began in 2011, it was initiated and paid by the international community, but, for Jukić, it was not an attempt to influence the judiciary. However, when their role in the HJPC has been called into question, then the BiH Presidency should protect them. It is therefore necessary, for the sake of chapters 23 and 24 of the European acquis communautaire to carry out the full judicial reform and to put the system fully in the function of the state and its citizens, and not some isolated centers of political power that are obviously feeling threatened by mere mentioning of these two European chapters, because, if the rule of law is to be established in BiH, they would be the first ones to be prosecuted by these judicial institutions,” Komšić stressed.

He noted that both the international community and citizens have obviously lost the confidence in the work and independence of the judiciary of Bosnia and Herzegovina, especially in the work of the High Judicial and Prosecutorial Council.

“It is highly indicative that the HJPC only now expresses concern for the constitutional order, and yet they have failed to do so when the borders of Bosnia and Herzegovina were being threatened, when illegally referendums were conducted contrary to the decision of the Constitutional Court of BiH and when individuals encouraged the rebellion within the Armed Forces of BiH,” Komšić stated in response to a letter Jukić sent to the BiH Presidency.
