Manual for judges and prosecutors on tackling corruption in public procurement

SARAJEVO, July 15 (FENA) – In order to increase the number of processed cases of corruption within the system of public procurement, the Anticorruption Network of Bosnia and Herzegovina (ACCOUNT) drafted the “Manual for judges and prosecutors: Tackling challenges of corruption in public procurement procedures”.

The manual was presented today by authors Adnan Tulić, who is the head of the Special Department of the Una-Sana Cantonal Prosecutor’s Office, and Mirela Porobić and Slobodan Golubović from ACCOUNT, who stressed today that they want to fight corruption in this way.

The manual is the result of the efforts of the ACCOUNT Network and its purpose is to put focus on the prevention of corruption and the efficient prosecution and sanctioning of criminal acts in public procurement.

BiH spent more than two billion KM per year on the system of public procurement and because of the great financial flows this area is extremely vulnerable to corruption, hence the reduction of corruption in this system would contribute to the reduction of corruption in the BiH society in general.

The Manual emphasizes examples of court practice, the specificity of the evidence of the criminal offense, and key dilemmas and problems in the practice of prosecuting corruption in public procurement.

ACCOUNT Network Director Eldin Karić said that this is contributing to those justice representatives who really want to fight corruption and it will also benefit everyone else in the chain from contracting authorities to relevant officials.

The need for amendments to the Public Procurement Law has also been emphasized, which would also allow for better prosecution of corruption, and the emphasis was put on introducing legitimate special investigative actions without which it is difficult to prove conspiracy agreement and criminal acts.
