Hadžibajrić: Public Procurement Law of BiH needs to be amended

SARAJEVO, October 27 (FENA) - Mayor of the municipality of Stari Grad, Ibrahim Hadžibajrić, believes that the BiH Public Procurement Law should be amended because it is not adapted to the needs of all levels of government, and is particularly problematic for local communities.

The Law regulates the public procurement system in BiH, establishes rules for public procurement procedures, by defining the rights, duties, responsibilities and legal protection of participants in the public procurement procedure, as well as the competencies of the BiH Public Procurement Agency and the Complaints Review Office.

Hadžibajrić believes that the latest amendment to that law, which should improve the efficiency of the procurement process, has been inadequate in terms of market conditions and needs and does not meet the requirements.

"Nowhere in the world in tender procedures, the lowest bidding price is the one that is crucial, but the one that is most favorable and cost-effective," Hadžibajrić said.

If a particular company takes part in a tender, whether it is the procurement of the goods or the execution of the works, several factors must be considered in order to decide on the best offer.

"In principle, the lowest price means the most expensive job in the end, and we have witnessed this in practice," said Hadžibajrić.

In the last four years, he said, the municipality has terminated three contracts with certain firms because those firms did not appear to be able to honor the contract.

"The municipality has suffered numerous losses as a result. For the job the selected contractors conducted, but we also have to pay a repeat of a tender procedure, the time loss, which is the most expensive, while the completion of the works gets delayed," said Hadžibajrić, although, he added, there also a way to negotiate a deal.

He believes that all problems can be avoided either by the new Law on Public Procurement or by amendments to the existing law, which would be adapted to the needs of local communities and the market.

"Whether it is a municipality, a canton, or an entity, we are in delay at all levels of government, and that is creating problems for us," said Hadćibajrić.
