Kahro Vejzović sentenced to four years of prison for war crime against civilians

SARAJEVO, November 21 (FENA) - The Court of Bosnia and Herzegovina, the Third Instance Panel of Section I for War Crimes handed down, on 27 September 2019, a third instance judgment in the case of Kahro Vejzović granting in part the appeal filed by counsel for the accused, and revising the Second Instance Judgment of the Court of 16 May 2019, in relation to the decision on sentence.

The accused, who was under the Judgment of 16 May 2019, found guilty of the criminal offense of War Crimes against the Civilian Population under Article 142(1) as read with Article 22 of the Criminal Code of the Socialist Federative Republic of Yugoslavia, which was taken-over on the basis of the Law on the Application of the Criminal Code of the Republic of Bosnia and Herzegovina and the Criminal Code of the SFRY, received a sentence of imprisonment for a term 4 (four) years.

The Second Instance Judgement remained unrevised in its remaining part. 

The First Instance Judgment of the Court of BiH of 31 August 2018 acquitted the accused Kahro Vejzović of the charges that he committed the criminal offense of War Crimes against Civilians under Article 173(1)c) as read with Article 180(1) of the CC BiH.

The Judgment of the Panel of the Appellate Division of the Court of BiH, handed down on 12 February 2019, upon an appeal filed by the Prosecutor’s Office of BiH, confirmed the acquitting part of the First Instance Judgment concerning Sections 2, 3, 4, 5, 6, 13 and 14, while in relation to Sections 1, 7, 8, 9, 10, 11 and 12 of the operative part the First Instance Judgment was revoked, and a hearing scheduled to be held before the Panel of the Appellate Division of the Court of Bosnia and Herzegovina.

After the hearing held before the Appellate Division Panel, the accused Kahro Vejzović was found guilty of the acts described in Sections 1-7 of the operative part of the Judgment whereby he committed the criminal offense of War Crimes against the Civilian Population under Article 142(1) as read with Article 22 of the Criminal Code of the Socialist Federative Republic of Yugoslavia, which was taken-over on the basis of the Law on the Application of the Criminal Code of the Republic of Bosnia and Herzegovina and the Criminal Code of the SFRY.

By applying the referenced provisions, and Articles 33, 38(1) and 41(1) of the CC SFRY, the Court sentenced him to imprisonment for a term of 6 (six) years.
