RSNA conclusions on self-determination and referendum optional

BANJA LUKA, December 18 (FENA) - The Council for the Protection of Vital Interest of the Constitutional Court of Republika Srpska has rejected a request by the Bosniak Caucus to the RS Council to determine the existence of a vital national interest of the constituent Bosniak people in connection to the conclusions on "Information on the unconstitutional transformation of the Dayton structure of BiH and the impact on the status and the rights of Republika Srpska".

This information was adopted at the session of the RS National Assembly held on 12 November 2019.

The Council's position is that the conclusions are a political position, which is not binding.

“The Council assessed that, given the content of the conclusions and issues that they deal with, it follows that these acts do not contain norms of a general nature, but rather that is an act expressing the political position of the National Assembly of the Republika Srpska regarding the information. Therefore, the Council has found, as it has done so far in similar legal situations, that it is not within its competence to assess the compliance of the disputed conclusions with the provisions of the Constitution that protect the vital national interests of the constituent peoples of Republika Srpska,” it is stated from the RS Constitutional Court.

The Bosniak caucus in the RS Council of Peoples raised the issue of protecting the vital national interest in connection to the conclusions of the RS National Assembly regarding "Information on the unconstitutional transformation of the Dayton structure of BiH and the impact on the status and rights of the RS".

On November 12, after the late-night session, the entity parliament adopted the conclusions of the caucuses of the Alliance of Independent Social Democrats (SNSD), Democratic People's Alliance (DNS), Socialist Party (SP), Democratic Alliance (DEMOS), People's Democratic Movement (NDP) and United Srpska (US).

Fifty-three deputies from the ruling majority voted in favor of these conclusions, no one opposed or abstained.

In addition to Bosniak MPs, representatives of the international community in BiH also disputed the conclusions of the entity parliament.

The RSNA adopted twenty conclusions in total, including the one that promotes peoples' rights to self-determination, announcing a new RS constitution, which will be voted on by citizens in a referendum, "in case of a failed reaction to the attempts to dissolve the Dayton Agreement."
