HJPC: Electronic records of confiscated assets available as of January 1

SARAJEVO, January 21 (FENA) - Implementation of the Module for Recording Confiscated Property / Property Acquired by Criminal Offenses began in courts and prosecution offices on January 1, 2020, announced the High Judicial and Prosecutorial Council of BiH (HJPC BiH).

The purpose of the application of the module is to facilitate the procedures for verification and submission of information in cases in which the prosecution has proposed, and the court has made a decision to confiscate illegally acquired property.

“A key issue for crime prevention is preventing criminals from profiting from illegal activities. The most important thing for each country is to disrupt the activities of criminal groups and discourage them from taking away the profit they made through criminal activities,” it is said in the statement.

As further stated, the data on the enforcement of court judgments that have imposed a measure of confiscation of the proceeds deriving from crime are crucial for the meaningful collection and processing of judicial data.

The HJPC points out that the establishment of the Module for Recording Confiscated Property / Property Acquired by Criminal Offenses is a very important segment of the overall efforts to place focus on this issue and position this area in BiH at the top of the priorities of the work of the judiciary and all other prosecution institutions.

“The new module can serve as an example of best practice to other countries in the region that need to build similar mechanisms,” said Dr. Eldan Mujanović, who supported the work on the module development.

Strict penalties not only punish crimes but also have an additional effect. Property seizure is a complementary measure in this regard and ensures that no one benefits from committing a crime.

The module was developed with the financial support of the European Union, and the Federal Agency for Confiscated Property Management provided expert input.

In order to simplify the implementation of the new module and to better understand the property seizure process, the HJPC has prepared user manuals on the use of the module and distributed it to courts and prosecution offices in BiH.

The exchange of best practices is important to ensure effective management of confiscated assets, which is why the European Union will also finance the organization of regional trainings in Sarajevo, Banja Luka, Tuzla and Mostar in the first half of 2020.
