Deputies refuse to establish responsibility for denying genocide and war crimes

SARAJEVO, January 23 (FENA) - Deputies in the House of Peoples of the Parliamentary Assembly of Bosnia and Herzegovina have rejected amendments to the BiH Criminal Code that would establish responsibility for those who deny genocide and war crimes, proposed by Croat caucus deputy Zlatko Miletić (Democratic front - DF).

DF MP suggested establishing responsibility for institutions that make decisions on the recognition, awards and privileges of convicted war criminals or the decision to appoint public facilities for sentenced war criminals convicted by final decisions of the International Court of Justice, the International Tribunal for the former Yugoslavia, or the domestic court.

The amendments, Miletić explained, would establish the legal and criminal liability of persons who deny or reject the judgments of international and domestic courts responsible for war crimes or crimes against humanity.

Miletić requested that the amendments to the Code be taken under urgent procedure, because, as he said, only two articles of the Code were amended, and he considered that the conditions for urgent legislative procedure were fulfilled.

He asked deputies to support the amendments now in the year marking the 25th anniversary of the Srebrenica genocide, and added that 90 people had been convicted of war crimes at The Hague tribunal, including domestic court rulings.

Similar amendments in the BiH Parliament have been in place since 2007 and have been periodically proposed by different deputies, warned Serb caucus deputy Dušanka Majkić (Alliance of Independent Social Democrats - SNSD).

She notes that the essence of this Code is important and she announced that, as before, the Serbs will not support it this time, saying that it would prohibit the defense in the courts of persons because they are forbidden to deny it.

Bakir Izetbegović (Party of Democratic Action - SDA) reminded the deputy that it is not about judging a nation but individuals, asking her if it is possible for people to defend themselves by denying genocide and war crimes.

"You mentioned the mass trials of Serbs, thank God there were no mass crimes against Serbs," he said at the same time, recalling how many non-Serbs were killed in the past war.

All five deputies from the Serb caucus and four Croat deputies voted against the bill, while proponent Zlatko Miletić and all five Bosniak caucus delegates voted in favor of the proposed amendments to the Criminal Code.
