SARAJEVO, February 7 (FENA) - The Constitutional Court of Bosnia and Herzegovina, after discussing procedural issues, decided that it will discuss the case U 11/19 (Request by the BiH Presidency member Milorad Dodik to review the constitutionality of the Law on Amendments to the Law on the BiH Flag) at one of the next sessions.
At its regular 117th plenary session, held on 6 and 7 February, the Constitutional Court of BiH considered appeals from individuals and legal entities and requests for reviews of constitutionality.
Among other, in the case (U 8/19), the Constitutional Court ruled on the request of seven deputies of the Council of Peoples of the Republika Srpska to review the constitutionality of Article 53 of the RS Law on Agricultural Land, which stipulates that the agricultural land in question is a public good by nature, that is state ownership, by force of law, becomes the property and possession of RS.
The Constitutional Court found that the impugned provision is contrary to Article I / 1, Article III / 3 (b) and Article IV / 4 (e) of the Constitution of BiH, as it is the exclusive competence of the State of BiH to regulate matters of state property.
In the opinion of the Constitutional Court, issues related to navigation on interstate and international rivers, as well as jurisdiction in this regard between state and entity bodies, should be regulated by a state-level law, since these issues are, according to the aforementioned provisions of the BiH Constitution, within the exclusive jurisdiction of the State of BiH.
The Constitutional Court held a discussion in the case AP 1140/19, Davor Dragičević’s s appeal filed for alleged lack of an effective investigation, and decided to render a decision in that case at one of the next plenary sessions.
All the decisions adopted at the 117th plenary session will be communicated to the appellants within one month and published as soon as possible on the website of the Constitutional Court of Bosnia and Herzegovina, the BiH Constitutional Court announced.
