Tegeltija: Reduced length of court proceedings

SARAJEVO, March 11 (FENA) - President of the High Judicial and Prosecutorial Council (HJPC) of Bosnia and Herzegovina, Milan Tegeltija, said today that the situation in the judiciary should be discussed continuously and to compare the situation from before to the one today in order to get a complete picture.

Addressing members of the House of Representatives of the BiH Parliamentary Assembly at a thematic session dedicated to the state of BiH judiciary, he assessed that he is in a specific situation, considering that a law envisaging the termination of the mandate of current HJPC members was passed at the last session of the House.

Citing information on the state of the judiciary, he said that the number of cases was halved compared to 2015 and that BiH is on the European average when it comes to the length of court proceedings, which is why the largest number of appeals are before the European Court of Human Rights in Strasbourg.

However, the court trial has been reduced from an average of 850 days to 380 days, but the whole of Europe has a problem with the length of the trial, Tegeltija notes.

He also noted that the age structure of pending cases is important, noting that the oldest cases have been resolved and the age structure of the cases is now one to three years.

Speaking about problems in the judiciary, he raised the issue of the lack of judicial institutions, especially prosecutors, and if that can be changed, the prosecutors' offices would be improved, adding that measures were being taken to speed up the resolution of the case.

“When it comes to corruption cases, the number of reports reduced the number of investigations required, which is very logical. This parameter has been measured since 2015 when there were 1,129 corruption reports, while in 2019 this number was 957,” explained Tegeltija.

He pointed out that improvements were also needed in the prosecution of corruption allegations, but also stated that in 2015 there were 89 convictions, while in 2019 there were 223 convictions, while there were 62 acquittals.

He also referred to complicated structure in BiH, which is the most complex of all countries in the region, since BiH has four independent judicial and prosecutorial systems, two supreme courts, one Court of Appeal of the Brčko District and the Court of BiH.
