BiH HoR MPs urge that the judiciary in the country needs major changes

SARAJEVO, March 11 (FENA) - Deputies of the House of Representatives of the Parliamentary Assembly of Bosnia and Herzegovina (BiH PA) pointed out today at a thematic session to the state of the judiciary and a number of in this pillar of government in BiH.

After the opening remarks by the President of the High Judicial and Prosecutorial Council (HJPC) BiH Milan Tegeltija, Chief Prosecutor of the Prosecutor's Office of BiH Gordana Tadić and the President of the Court of BiH Ranko Debevec, a parliamentary debate followed, noting first of all the slowness of the case proceedings and the illogical nature of certain court processes.

The Social Democratic Party (SDP) MP Saša Magazinović criticized Tadić for harshly addressing the deputies, saying she disrespected this highest state institution and urged her to begin arresting politicians suspected of committing corruption, but urged her to do so with care to keep the evidence from getting lost, which he says often happens.

“This session will be useful if people representing the judicial institutions have enough courage and say the names of the murderers of David Dragičević and Dženan Memić. They were killed,” Magazinović said and warned about the decision on the promotion of the Sarajevo Cantonal Prosecutor General Dalida Burzić.

“The HJPC is most responsible for the situation in the judiciary today,” said the Party Democratic Action (SDA) deputy Šemsudin Mehmedović, saying that they deviated from the main principles, but the position is that the existing law governing their work needs to be amended. He also pointed to the fact that there were many scandals that shook that judicial institution.

Due to the fact that the Chief Prosecutor Gordana Tadić on a number of occasions interrupted the deputies in their address, the Serb Democratic Party (SDS) MP Dragan Mektić said there was an intention to make a mess today by interrupting the deputies and to cause adjourning of the session.

The question of the SDP MP Zukan Helez on why the SNSD leader Milorad Dodik was not arrested when he threatened the BiH constitutional order has sparked a storm of comments by deputies coming from Republika Srpska who urged Helez "not to call for retaliation against Dodik".

In the replies to Helez's statements, the SNSD MP Sanja Vulić will surely leave an indelible mark in the history of the House by saying that "Dodik is a god to her, and that he in the Republika Srpska is by far the grandest person, even greater than Tito ever was”.

“I do not allow you to talk about him like that and call for retaliation against him and his family. If you feel we cannot live together, suggest some solutions,” she said.

She received a reply from the House Speaker Denis Zvizdić (SDA), who explained to her that her statement greatly offends believers, arguing that everyone should take heed of the words they utter and respect different political, religious and human sentiments.

The SDP deputy Zukan Helez also recalled the reactions of judicial institutions in Spain following the referendum on Catalonia's independence, saying that the BiH Prosecution's work was by far the worst and that public perception was the most sensitive to this issue.

“When it comes to corruption and crime, the largest percentage of prosecuted persons falls under the category of petty criminals. These are cases of illegal logging, petty drug dealers, etc. They treat theft in logging as an economic crime, but what about the ‘Pandora’ case, which is a crime with damages of more than a billion KM,” Helez asked.

The issue of why the thematic session was convened was addressed by SDA MP Adil Osmanović, who asked where the debate on the situation in the judiciary should be conducted if not in this House, because without the participation of representatives of all levels of government it is difficult to expect an improvement in the situation.

Today's debate, he says, should offer answers so that the justice system can make life better for BiH citizens, and said that it is precisely the parliament that should review the HJPC's work report at least twice a year, respecting the impartiality and independence of the judiciary.
