Cvijanović: BiH Constitutional Court wants to strip the RS of its property

BANJA LUKA, June 9 (FENA) - President of the entity of Republika Srpska, Željka Cvijanović claims that the Constitutional Court of Bosnia and Herzegovina is the only constitutional court in the world that “does not protect constitutionality, but makes political decisions,” and that “the property of the entity will remain its property.”

Commenting on the fact that the Constitutional Court of BiH adopted an appeal against the decisions of the Supreme Court of RS and the County Court in Trebinje regarding the registration of military property, Filipovići storage site in Foča, Cvijanović told reporters in Banja Luka that "it is a proven fact that the Constitutional Court of BiH aims to strip the RS of its property.”

“What is even worse is that this court makes unconstitutional decisions. The fact that you have foreign judges there who often form a voting bloc to make decisions against the RS already speaks to the lack of legitimacy, authority and credibility of that court.

On the other hand, there are dozens of decisions of that court that have not been implemented or have only been partially implemented, which also puts a big question mark on the credibility and everything that this constitutional court should represent.

Everything that the OHR used to do, making certain decisions that went beyond the constitutional framework, in order to somehow enhance the state-level capacities and strip or deny the competencies of the RS, is now continued by the Constitutional Court and we have a clear policy behind it all,” stated Cvijanović.

The RS has enough room to decide on this issue and show its position when it comes to its property, she added.

“That what is property of the RS will remain its property. Nowhere in the Constitution does it say that it belongs to Bosnia and Herzegovina. Privatization was carried out on the basis of territorial and functional principles, and all other processes were resolved on these principles. This is a case of stepping out of boundaries on what is essentially important, which is the fact that, in addition to the competencies you have, you must also have your own property,” Cvijanović stated.
