Prohibitive measures imposed against Kandić and others suspected of war crimes

SARAJEVO, December 20 (FENA) - The Court of Bosnia and Herzegovina issued a Decision denying the 17 December motion filed by the Prosecutor's Office of Bosnia and Herzegovina to order custody of the suspects Zdravko Kandić, Dragan Đurđić, Dragan Ivanišević, Goran Došlo, Milan Trifković, Siniša Kandić, Dragoslav Aćimović and Mladen Kandić on the grounds set forth in Article 132 of the CPC BiH, being a flight risk, and due to particular circumstances indicating they might hinder the criminal proceedings by interfering with the witnesses, accomplices or accessories.

Under the same Decision, the following prohibitive measures were imposed on the suspects Zdravko Kandić, Dragan Đurđić, Dragan Ivanišević, Goran Došlo, Milan Trifković, Siniša Kandić, Dragoslav Aćimović and Mladen Kandić:

Ban on leaving their places of residence, meaning their addresses of residence (so-called house arrest) under Article 126(1) CPC BiH.

Travel ban, under Article 126(2) CPC BiH, in the manner that the suspects are forbidden from traveling outside of Bosnia and Herzegovina.

Ban on meeting with certain individuals under Article 126.a(1)c) CPC BiH, in the manner that the suspects are prohibited from meeting or in any way contacting (directly or indirectly) the witnesses listed in the Prosecutor’s Motion to order custody dated 17 December 2021, as well as other potential witnesses, including a 100-meter injunction ban, while also prohibited are mutual contacts between the suspects, as well as their communication with co-perpetrators known to them, as well as other accomplices or accessories to the commission of the given criminal offense.

Zdravko Kandić, Dragan Đurđić, Dragan Ivanišević, Goran Došlo, Milan Trifković, Siniša Kandić, Dragoslav Aćimović and Mladen Kandić are suspected of the criminal offense of Crimes against Humanity under Article 172 of the Criminal Code of Bosnia and Herzegovina (CC BiH) and the criminal offense of War Crimes against Prisoners of War under Article 175, as read with Article 180 of the CC BiH.
