TIBiH: Insufficient progress in transparency of institutions

SARAJEVO, September 28 (FENA) - Research by Transparency International in BiH (TIBiH) regarding the application of the Law on Freedom of Information in BiH this year showed that there is not enough progress in the transparency of institutions and that only about 50 percent of public bodies submits information within the deadlines prescribed by law. 

TIBiH presented the results of the research today at a conference in Sarajevo on the occasion of the International Day for Universal Access to Information, which is celebrated on September 28.

“This is one of the activities where we try to point out the importance of making information of public importance available, that public institutions and bodies deliver and publish all the information that is important to citizens, starting with how public funds are spent, how institutions act and how decisions are made, which includes a large amount of information that can be considered of public importance,” said the executive director of TIBiH Ivana Korajlić.

The analysis, she added, also shows that there is a problem with proactive transparency.

“Institutions do not publish the very information that should be available, and the mechanisms for protecting the right of citizens to access information are insufficient, even when we talk about ensuring application by competent institutions and judicial protection, where we are also often forced to initiate disputes against institutions that violate the Law on Freedom of Information and that these procedures take a long time and that we do not have timely protection of rights when it comes to access to information,” Korajlić added.

According to her, there are also some negative trends, especially when it comes to excluding certain information using excuses from the law so that very important things are not published. First of all, as Korajlić said, we are talking about contracts that are of great importance, starting with concessions and infrastructure projects, where we are increasingly referring to the commercial interests of third parties.

During the conference, TI BiH presented an online database of court practices in cases related to freedom of access to information.
