Sarajevo Canton's Court confirms indictment against Senaid Memić and others

SARAJEVO, July 21 (FENA) - The Prosecutor's Office of the Sarajevo Canton (SC) filed and the Sarajevo Canton's Court confirmed the indictment against the former mayor of the Ilidža Municipality Senaid Memić, Ljiljana Eterović, expert advisor for legal affairs in the Spatial Planning Service, Adnan Ćenanović, Azra Mulaosmanović, expert associates for urban planning affairs, and municipal construction inspectors Amir Arnautović and Sanja Čizmedžić. All six defendants are charged with a criminal offense - abuse of position or authority.

The defendant Senaid Memić is accused of having, together with the other defendants, employees of the Ilidža Municipality, from 2015 to 2017, after initially issuing the urban development consent to the investor of the residential and commercial building 'Panamera' for the construction of the building which includes the ground floor and four floors in accordance with the planning documents, at the request of the investor, in March 2015 he enabled the construction of seven floors, although according to the Regulatory Plan and existing laws the construction of up to four floors is allowed, announced the SC Prosecutor's Office.

As it is further stated, in this way, the defendant Senaid Memić obtained a material benefit to the investor "Panamera" in the amount of 9,944,000 KM, but also an illegal benefit in the form of the unhindered construction of additional residential space intended for sale. 

The defendant Ljiljana Eterović, Adnan Ćenanović, and Azra Mulaosmanović, in their capacity as officials of the Spatial Planning Service, acted on the instructions of Memić and drew up illegal permits that he ultimately signed, while the building inspectors Amir Arnautović and Sanja Čizmedžić failed to control the construction and urban planning Decisions, which had to be declared null and void.

The defendants applied the same modus to the request of the Malak Group investor.

Namely, Memić facilitated the illegal construction of a hotel with seven floors, even though the Regulatory Plan allows the construction of up to four floors. In this way, the investor 'Malak Group' obtained an illegal benefit in the amount of 14,097,472 KM and the benefit of the construction of additional office space.

At the same time, the defendants are accused of having enabled the owner of the 'Brajlović' restaurant in Ilidža to illegally build and use a parking space in the area of the Željeznica River next to the restaurant, in violation of regulations on protection against the harmful effects of water.  

In the indictment, the acting prosecutors proposed confiscation of property benefits from the legal entity 'Panamera' in the amount of 9,944,000 KM and from the legal entity 'Malak Group' Sarajevo 14,097,472 KM.

A temporary measure has been set to prohibit the confiscation and encumbrance of part of the real estate in the Panamera residential and commercial building and the entire Malak Group hotel.

The defendant Senaid Memić was proposed to be banned from performing the duties of a responsible person in the civil service, public enterprises, or any other legal entity for 10 years from the date of entry into force of the verdict.
