Nikšić: HDZ BiH wants to legitimize the results of ethnic cleansing

SARAJEVO, January 14 (FENA) - President of the Social Democratic Party of BiH Nermin Nikšić said in a statement for the public that the request to review the constitutionality of the provisions of the FBiH Constitution, submitted by Borjana Krišto to the Constitutional Court of BiH, has ultimately revealed the intent of HDZ BiH on what kind of state and political system they want to establish in BiH.

Nikšić states that "it is now clear to everyone that HDZ wants to legitimize the results of ethnic cleansing, because to them, this constitutional provision is controversial, and the purpose of it is exactly not to legitimize and recognize the remnants of the war, expulsion and persecution of citizens in the territory of FBiH."

He added that the provision which ensures that at least one delegate from each nation may be elected from each canton, if at least one such deputy has been elected to the cantonal assemblies, has been part of the FBiH Constitution since the 1994 Washington Agreement.

“The whole purpose of this provision was then, as it is today, the provision of the possibility that in spite of expulsion and ethnic cleansing, all peoples throughout the entire FBiH have the possibility of being elected to the House of Peoples. Unfortunately, this provision has not been extended to the whole country with the Dayton Peace Agreement of 1995, therefore there is no such constitutional protection in the RS Constitution, which is why returnees to this part of BiH are still victims of institutional inequality, which must change,” said Nikšić.

He stated that this request confirms that "the proposal of HDZ BiH on amendments to the Election Law of BiH, in the part referring to the House of Peoples of the FBiH Parliament, is in fact, unconstitutional". Instead of withdrawing such an unconstitutional proposal, now they want to harmonize the FBiH Constitution with it, which is absurdity.

Nikšić also says that this move by HDZBiH "has opened up the possibility of challenging the various provisions of the FBiH Constitution, as well as the Constitution of RS and even some annexes of the Dayton Agreement itself, before the Constitutional Court of BiH, and that everyone in BiH must be aware of the possible consequences of such actions."

“It is clear that HDZ, in this way, is creating an alibi for itself in the case they embark on blocking the entire country, when they do not like the election results in October 2018 and it is their attempt to topple the democratic order. It is high time to stop the blockade of the FBiH Parliament, and convene and hold an extraordinary session to discuss the proposal of the Law on Electoral Units and the number of mandates in the FBiH Parliament, jointly proposed by SDP and DF,” stressed Nikšić.
