SARAJEVO, January 15 (FENA) - The Panel of Judges of Section I for War Crimes at the Court of Bosnia and Herzegovina, in the criminal case against the accused Slobodan Karagić, having held a public trial, delivered a judgment finding the accused Slobodan Karagić guilty of the criminal offense of War Crimes against Civilians under Article 142(1) of the Criminal Code of the Socialist Federal Republic of Yugoslavia (CC SFRY), and in Section 2.a) of the Conviction the criminal offense of War Crimes against Civilians under Article 142(1) of the CC SFRY, as read with Article 22 of the same Code, which was adopted pursuant to the Law on the Application of the Criminal Code of the Republic of Bosnia and Herzegovina and the Criminal Code of SFRY.
The accused Slobodan Karagić was found guilty that during the war in Bosnia and Herzegovina, from May 1992 to late August 1992, as a member of the CSB Doboj Special Unit, a.k.a. “Red Berets (Crvene beretke)“, and subsequently as its commander, and a member of the Army of Republika Srpska (VRS), VP 7051 Doboj, acting in violation of Article 3 of the Geneva Convention for the Protection of Civilian Persons in Time of War of 12 August 1949, alone or together with other VRS members, he took part in unlawful detention of civilians in the territory of Doboj municipality, and the rape of juvenile Bosniak women.
The Court of Bosnia and Herzegovina sentenced the accused Slobodan Karagić to 12 (twelve) years of imprisonment.
Pursuant to Article 284, Subparagraph c), of the CPC BiH, the accused Slobodan Karagić is acquitted of the charges that between the spring of 1992 and the autumn of the same year, within a widespread and systematic attack launched by the RS army and police against non-Serb civilians in the Doboj municipality, knowing of such an attack, as Commander of the CSB Doboj Special “Crvene beretke“ Unit, he acted in violation of Article 3 of the Geneva Convention for the Protection of Civilian Persons in Time of War of 12 August 1949, by participating, alone or together with other VRS members, in taking the unlawfully detained Bosniak civilians from the Spreča Central Prison in Doboj, to the camp at Vila, Municipality of Doboj, during the training of Crvene beretke members, where they were killed, and their bodies have yet to be found; by participating in the arrest of able-bodied Bosniak civilians, whom he, together with other VRS or police members, then took to the MUP building in Doboj and the detention centers of Perčin disko and hangars at Usora, Municipality of Doboj; by participating in the looting of prisoners at the foregoing detention centers, in violation of the fundamental rules of international law, and by committed other inhuman acts with the intention of inflicting serious suffering, physical injuries and health violation, whereby he would have committed, by the actions described in Section 1 of the Acquittal, the criminal offense of Crimes against Humanity under Article 172(1) Subparagraphs i) and a) of the CC BiH, as read with Article 29 and Article 180, Paragraphs 1 and 2, of the same Code; by the actions described in Section 2.a) of the Acquittal the criminal offense of Crimes against Humanity under Article 172(1), Subparagraph e) and f), as read with Article 180(1) of the CC BiH and by the actions described in Section 3.a) and b) of the Acquittal the criminal offense of Crimes against Humanity under Article 173(1)f) as read with Articles 29 and 180(1) of the same Code.
Pursuant to Article 188(4) of the CPC BiH, the accused is relieved of the obligation to cover the costs of criminal proceedings, which shall be paid from within the Court’s budget appropriations, stated the BiH Court.
