CRA fines TV FBiH, OBN, PINK BH and Radio Kameleon

SARAJEVO, February 6 (FENA) - Communications Regulatory Agency (RCA) issued a written warning to the Radio Television of the Federation of Bosnia and Herzegovina (TV FBiH) for violation of Article 25 (Schedule and marking of content for the purpose of protection of minors) of the Audiovisual and Radio Media Services Code.

The Agency found that the FBiH TV broadcasted on 11 October 2017 at 23:00 hours the movie "LOVE", which contained several scenes showing explicit and detailed sexual activities at an inappropriate hour.

The Article 25 of the Code clearly stipulates the responsibility of the media provider to ensure the protection of minors from potentially inappropriate and harmful content, as well as the responsibility for categorizing all the content provided, and clearly defines graphic labels and categories of program content to which they are related, as well as the time slots in which certain content can be broadcasted with respect to the category they belong to.

OBN Television was fined with 6,500 KM for the broadcast of the “Balkan Astro Center - Stars' Advice”, during which the telephone numbers for the participation of viewers from abroad were played in the lower part of the screen while the numbers in the upper right corner were for viewers from Bosnia and Herzegovina with the associated call price without VAT.

It has also been found that the price of services for viewers from BiH was smaller than the prescribed 2/3 of the size of the visible number for the call.

PINK BH Television was imposed a unique fine in the amount of 9,000 KM for violation of privacy protection and participation of juveniles in the content of media service providers.

PINK BH broadcasted a report on the family tragedy of Serbian actor Srđan Žika Todorović, that is, the sudden death of his three-year-old son, as part of the “EKSKLUSIVno” show. PINK BH misused the family tragedy by violating the obligation to respect privacy and without any apparent public interest, guided by the obvious need for sensationalism and exclusivity, for which reason the Agency had imposed the appropriate punitive measure.

Radio Kameleon was bereft of the program conditions contained in Annex 1 for the Radio Kameleon Sarajevo program, in connection with the violation of the transfer of the license and the technical conditions for broadcasting the frequencies 101.20 MHz and 95.90 MHz, of the license for General Radio Broadcasting through the terrestrial broadcasting and measures of the written warning for violation of Article 20.

In this case, it was about the illegal broadcasting of programs on assigned resources and the non-compliance with the program conditions granted by the license.
