BiH Court - Indictment partly confirmed in the case of Mane Đurić et al.

SARAJEVO, March 7 (FENA) - On 19 February 2018, the Court of Bosnia and Herzegovina partly confirmed the indictment charging the accused Mane Đurić, Radenko Stanić, Miroslav Kraljević and Goran Garić with the criminal offense of Crimes against Humanity under Article 172(1)h) as read with Subparagraphs a), e), f), g), i) and k) of the Criminal Code of BiH, all in conjunction with Article 180(1) and Article 29 of the same Code.

The Indictment charges the accused Mane Đurić, Radenko Stanić and Miroslav Kraljević that between mid-April 1992 and late March 1993, in the municipality of Vlasenica, they participated in a widespread and systematic attack launched by parts of the Yugoslav People’s Army (hereinafter: the JNA), specifically the Novi Sad Corps, the Municipal Staff of the Vlasenica Territorial Defense (hereinafter: TO Vlasenica), paramilitary formations, the Army of the Serb Republic of Bosnia and Herzegovina, subsequently the Army of Republika Srpska (all the above hereinafter: the military), the Ministry of Internal Affairs of the Serb Republic of Bosnia and Herzegovina, subsequently Republika Srpska (hereinafter: the police), against the Bosniak civilian population of the Vlasenica municipality.

Mane Đurić, as Head of the Vlasenica Public Security Station (hereinafter: the SJB Vlasenica), the office he assumed on 8 May 1992, and at the same time a member of the Vlasenica Municipality Crisis Staff, subsequently the Vlasenica Municipality War Presidency, Radenko Stanić as SJB Vlasenica commander, the office he assumed on 1 April 1992, where, given the duties they performed they were superior to all members of the special platoon of the SJB Vlasenica, with actual control over the Station and its members activities, Miroslav Kraljević as special platoon commander within the SJB Vlasenica, the office he assumed on 14 May 1992, with actual and effective control over the platoon, also known as “Mića’s special forces“ (hereinafter: the special platoon of the police), acting with a discriminatory intent, committed persecution of the Bosniak civilian population of the Vlasenica municipality, on political, national, cultural, ethnic and religious grounds.

They are charged with unlawful detention, inhumane detention in inhumane conditions in violation of the rules of international humanitarian law, murders, torture, sexual abuse, forced disappearance of persons, attack on the civilian population and undefended positions and other inhumane acts of similar nature committed with the intent to inflict serious suffering or physical or mental injury or violation of health.

As the indictment reads, they committed this in the manner that they enabled, organized, planned, ordered, aided and abetted, instigated, arranged for the commission and omission of certain measures, with unlawful arrests of Bosniak civilians, carried out by SJB Vlasenica members and SJB Vlasenica special police platoon members subordinated to them.

They also enabled and organized their detention on the SJB Vlasenica premises and the prison building behind the Vlasenica court, as well as the Sušica camp in Vlasenica, where the detainees were held in inhumane conditions, abused and subjected to forced disappearance by members of the SJB Vlasenica police and special police platoon, the crimes they supported and enabled, although under the obligation to protect the civilians, thus contributing to creating and maintaining a climate of impunity for such crimes, in which they took direct part alone or with other police and special police platoon members.

The accused Goran Garić is charged that between mid-April 1992 and late March 1993, in the municipality of Vlasenica, within a widespread and systematic attack launched by parts of the Yugoslav People’s Army (hereinafter: the JNA), specifically the Novi Sad Corps, the Municipal Staff of the Vlasenica Territorial Defense (hereinafter: TO Vlasenica), paramilitary formations, the Army of the Serb Republic of Bosnia and Herzegovina, subsequently the Army of Republika Srpska (all the above hereinafter: the military), the Ministry of Internal Affairs of the Serb Republic of Bosnia and Herzegovina, subsequently Republika Srpska (hereinafter: the police), against the Bosniak civilian population of the Vlasenica municipality, knowing of the attack and that his actions constituted part of the attack, as an active member of the SJB Vlasenica police, he committed persecution of Bosniak civilians on political, national, cultural, ethnic and religious grounds, by murder, torture and other inhumane acts of similar nature committed with the intent to inflict serious suffering or physical or mental injury or violation of health, the BiH Court stated.
