SARAJEVO, March 21 (FENA) - Deciding upon the Prosecution Motion to terminate custody and order prohibiting measures, on 22 March 2018, the Court of Bosnia and Herzegovina rendered the Decision terminating the custody of Suspect Mirsad Brkić and ordering the following prohibiting measures:
Ban on leaving the place of residence - house arrest (with the obligation of the authorized officials to make random checks once a day in the period from 08:00 a.m. to 10.00 p.m.);
Travel ban, with the seizure of all travel documents issued to the Suspect and ban on issuing new ones, as well as the ban on crossing the border with the use of the ID card;
Ban on meeting with certain persons - Suspect Mirsad Brkić is banned from any form of contacting or liasing with other suspects in the case, and contacting and liasing with Prosecution witnesses, including contacts by phone, directly or indirectly.
The imposed prohibiting measures may last as long as necessary, or pending a new Decision of the Court. The review of justifiability of the measures shall be carried out on a bimonthly basis.
Pursuant to Article 126b Paragraph 3 of the CPC of BIH, the Suspect is warned that he would be ordered into custody should he violate the prohibiting measures.
Mirsad Brkić is suspected of the criminal offense Organized Crime in violation of Article 250 of the Criminal Code of Bosnia and Herzegovina as read with the criminal offense of Smuggling in violation of Article 214 of the CC of BIH and the criminal offense of Aggravated Theft in violation of Article 287 of the CC of FBIH and the criminal offense of Extortion in violation of Article 295 of the CC of FBIH in conjunction with Article 53 of the CC of BIH.
