SARAJEVO, March 28 (FENA) - Pronouncement of Judgment before the Appellate Panel in the case of Edin Sakoč is scheduled for 29 March 2018, at 12.00 hrs, in Courtroom 7, the BiH Court announced.
Under the Decision of the Appellate Panel of the Court of Bosnia and Herzegovina No. S 1 1 K 020968 17 Krž 2, of 31 October 2017, the respective Appeals by the Prosecutor's Office of Bosnia and Herzegovina and the Defense Counsel for the Accused Edin Sakoč from the Judgment of the Court of BiH No. S 1 1 K 020968 16 Kri of 10 March 2017, were granted, the Judgment was revoked and a hearing before the Appellate Panel was scheduled. After the completion of the hearing before the Appellate Panel, the pronouncement of Appeals Judgment has been scheduled.
Under the Trial Judgment of the Court of BiH No. S1 1 K 020968 16 Kri of 10 March 2017, the Accused Edin Sakoč was found guilty that, by the acts described in Section I of the enacting clause of the Judgment, he committed the criminal offense of War Crimes against Civilians in violation of Article 142(1) of the Criminal Code of the Socialist Federal Republic of Yugoslavia (CC SFRY), as read with Article 22 of the CC SFRY, and, in the application of Articles 33, 38 and 41 of the CC SFRY, sentence of imprisonment for the term of 7 (seven) years was imposed on him. The time he spent in custody from 19 February 2016 to 17 March 2016 was credited toward the pronounced sentence, pursuant to Article 50 of the CC SFRY.
Under the same Judgment, pursuant to Article 284(c) of the Criminal Procedure Code of Bosnia and Herzegovina (CPC BiH), the Accused Edin Sakoč was acquitted of the charges that by the acts described in Section II of the enacting clause of the Judgment he would have committed the criminal offense of War Crimes against Civilians in violation of Article 173(1)(e) of the Criminal Code of Bosnia and Herzegovina (CC BiH), reads the statement of the BiH Court.
