CISAC adopts resolution on copyright infringement in BiH

SARAJEVO, April 5 (FENA) - The International Confederation of Societies of Authors and Composers (CISAC)'s Regional European Committee adopted at a session in Belgrade a Resolution on copyright infringement by public broadcasters in Bosnia and Herzegovina.

At the end of 2017, the initiative for the adoption of this resolution was started by the Association of Music Composers (AMUS) due to the continuous and persistent refusal of public broadcasters in BiH to approach the conclusion of contracts and respect the copyright obligations regarding the use of copyright-protected music pieces in their radio and TV program.

The purpose of the adoption of the Resolution is to resolve the issue of unauthorized and negligent activity of public broadcasters in BiH (Radio Television of Bosnia and Herzegovina - BHRT, Radio Television of Federation of Bosnia and Herzegovina - RTV FBiH and Radio Television of Republika Srpska - RTRS) in respect of music rights.

With this resolution, CISAC, whose mission is to protect and defend the moral and economic interests of more than four million authors worldwide, urges primarily the public broadcasters in BiH to recognize AMUS as a legitimate key partner and to respect its legal obligations in accordance with national copyright legislation rights and international agreements signed by Bosnia and Herzegovina, AMUS said. 

CISAC also urges all relevant public authorities and bodies in Bosnia and Herzegovina to provide all available assistance to AMUS in the proper implementation of the Collective Exercise of Copyright and Related Rights Act and to bring public broadcasters to the negotiating table to provide appropriate compensations for authors of musical pieces whose works were used in the past period by the public broadcasters but also for any future use of copyrighted music pieces in their programs. 

CISAC expressed support for all legal proceedings and actions initiated by AMUS against them to prevent further copyright infringement and provide retroactive fair compensation for used copyrighted music pieces, while expecting the courts in Bosnia and Herzegovina to act according to the highest legal standards by solving fairly and swiftly the legal proceedings in accordance with the applicable legal norms, the statement reads.
