BiH Court - Suspects Maksim Božić and Edin Hastor ordered into pre-trial custody

SARAJEVO, April 13 (FENA) - On 12 April 2018, deciding on the Motion filed by the Prosecutor's Office of Bosnia and Herzegovina to order custody of the suspects Maksim Božić and Edin Hastor, the Court of Bosnia and Herzegovina issued a decision partly granting the Prosecutor’s Motion and ordering the suspects into pre-trial custody on the custody grounds provided in Article 132(1)b) and c) of the Criminal Procedure Code of Bosnia and Herzegovina, while the Court denied as ill-founded Prosecutor’s Motion to order the suspects into custody on special custody grounds under Article 132(1)a) and d) of the CPC BiH. According to the Decision, their pre-trial custody may last 1 (one) month at the longest, running from the day of their arrest, which means until 10 May 2018 or pending a different decision of the Court.

Having reviewed the submitted evidentiary material, the Court has found there existed grounded suspicion that the suspects committed the criminal offense they have been charged with, which is why it ordered them into custody on the grounds of reasonable concern that if released they would hinder the criminal proceedings by interfering with the witnesses and accomplices, and due to the special circumstances justifying the concern that they may repeat or complete the criminal offense or commit the criminal offense they had threatened with, which all carry a sentence of three years of imprisonment or a more severe punishment.

Maksim Božić and Edin Hastor are suspected of the criminal offense of Terrorism under Article 201(4) as read with Paragraph 1, all in conjunction with Article 29 of the Criminal Code of Bosnia and Herzegovina, the BiH Court stated.
