SARAJEVO, May 3 (FENA) - In the criminal case against the Accused Saša Savinović a Panel of Section I for War Crimes of the Appellate Division of the Court of Bosnia and Herzegovina held a session whereupon it rendered a verdict dismissing the Appeal by the Defense Counsel as unfounded and upholding the verdict of the Court of BH No. S1 1 K 020301 16 Kri of 30 October 2017.
Under the Verdict of the Court of BH No. S1 1 K 020301 16 Kri of 30 October 2017, the Accused Saša Savinović was found guilty that by the acts described in the enacting clause he committed the criminal offense of Crimes against Humanity in violation of Article 172(1)(h), as read with Sub-Paragraph (a) (acts referred to in Count 1 of the Indictment) and Sub-Paragraph (d) (acts referred to in Count 2 of the Indictment) of the Criminal Code of Bosnia and Herzegovina (CC BH), all as read with Article 29 of the CC BH.
Therefore, pursuant to the referenced law and in application of Articles 39, 42, 48 and 49 of the CC BH, for that offense the Court sentenced him to imprisonment for a term of 8 (eight) years. Under the same Judgment, pursuant to Article 56 of the CC BH, the time the Accused spent in custody in the period from 28 October 2015 to 24 November 2015 was credited toward the pronounced sentence of imprisonment.
The Defense Counsel for the Accused filed a timely appeal from the Judgment on the grounds of essential violations of the provisions of criminal procedure, violation of the Criminal Code, incorrectly and incompletely established state of the facts, and the decision on criminal sanction, and moved the Appellate Panel of the Court of BH to grant the Appeal and revise the contested Judgment by acquitting the Accused of the charges completely or partially, that is, by reducing the pronounced sentence.
The Prosecutor's Office of BH filed a response to the Defense Appeal and moved the Appellate Panel to dismiss the Appeal as unfounded and to uphold the contested Judgment.
Pursuant to Article 304(4) of the CPC BH, the Appellate Panel held a session on 13 April 2018, at which the Defense Counsel presented orally the averments from the Appeal and stated that she stood by them in entirety.
The Prosecutor having conduct of the case presented his oral response to the Defense Appeal and moved the Court to dismiss it completely as unfounded. The Accused Savinović maintained the arguments of his Defense Counsel, stated the BiH Court.
