SARAJEVO, May 10 (FENA) - The pronouncement of judgment before the Appellate Panel in the case of Ekrem Ibračević et al. has been scheduled for 11 May 2018, at 9 a.m., Courtroom 7, the BiH Court stated.
The Judgment delivered by the Appellate Panel of the Court of BiH, No. S 1 1 K 016488 17 Krž, dated 12 July 2017, granted the appeal filed by defense counsel for the accused Ekrem Ibračević against the judgment handed down by the Court of Bosnia and Herzegovina No. S 1 1 K 016488 14 Kri of 28 October 2016, so the trial judgement was overturned in its convicting part and a retrial was ordered before the Appellate Division Panel of the Court of Bosnia and Herzegovina, while the appeal filed by the BiH Prosecutor's Office with regard to the acquittal was refused as ill-founded, and the judgment of the Court of Bosnia and Herzegovina No. S1 1 K 016488 14 Kri of 28 October 2016 was upheld in that part.
The Trial Judgment issued by the Court of BiH, No. S1 1 K 016488 14 Kri of 28 October 2016, had found the accused Ekrem Ibračević guilty that by the actions described in the conviction he committed the criminal offense of War Crimes against Civilians under Article 142(1) of the Criminal Code of the Socialist Federative Republic of Yugoslavia (CC SFRY) as adopted based on the Law on the Application of the Criminal Code of the Republic of Bosnia and Herzegovina and the Criminal Code of SFRY, as read with Article 22 of the same Code, following which the Trial Court, applying the foregoing statutory provisions, as well as Articles 33, 38, 41, 42 and 43 of the CC SFRY, sentenced him to 3 years of imprisonment.
The same judgment, conversely, and pursuant to Article 284, Subparagraph c), of the Criminal Procedure Code of Bosnia and Herzegovina, acquitted the accused Ekrem Ibračević, Faruk Smajlović and Sejdalija Ćović of the charges that by the actions described in the acquittal they committed as follows, the accused Ekrem Ibračević the criminal offense of War Crimes against Civilians under Article 173(1), Subparagraphs c) and e) of the Criminal Code of Bosnia and Herzegovina (CC BiH), and the accused Faruk Smajlović and Sejdalija Ćović the criminal offense of War Crimes against Civilians under Article 173(1)c) of the CC BiH, all in conjunction with Article 180(1) of the same Code.
