SARAJEVO, June 17 (FENA) - The Preliminary Proceedings Judge of the Court of Bosnia and Herzegovina has issued a decision to discontinue the extradition procedure against the wanted person Zdravko Mamić on the grounds that the legal requirements for the extradition of own citizen have not been met.
The wanted person was brought before the Preliminary Proceedings Judge based on international diffusion issued by NCB Interpol Zagreb, Croatia, following an arrest warrant issued by the District Court in Osijek, for the purpose of executing the sentence of 6 years and 6 months of imprisonment, for the committed criminal offense of Abuse of Trust in Business Dealings under Article 246, Paragraphs 1 and 2, as read with Article 51, of the Croatian Criminal Code.
At the relevant hearing, in the presence of his defense counsel, the wanted person was informed about the reasons for his arrest. He said he expressly opposed his extradition on the grounds that he possesses BiH citizenship, which he proved by the documents produced. His defense counsel confirmed what his client said, citing the provisions set forth in the Agreement on Extradition of Own Citizens concluded between Bosnia and Herzegovina and Croatia.
Taking into account the submitted documentation, and the fact that the criminal activities constituting the elements of the criminal offense the wanted person is being sought for, and for which he was sentenced by a non-final judgment, were committed before the Agreement was signed, the Court issued a decision to discontinue the extradition procedure, stated the BiH Court.
