SDA: Ethnically-based exclusion of Bosniaks from the judiciary is unacceptable

SARAJEVO, January 22 (FENA) - The Party of Democratic Action (SDA), demands that, when appointing the Chief Prosecutor of the Prosecutor's Office of Bosnia and Herzegovina, the High Judicial and Prosecutorial Council finally corrects the ethnic imbalance currently present in the judicial institutions of BiH.

“We demand that the High Judicial and Prosecutorial Council appoint a person of high moral and professional qualities from the ranks of the Bosniak people, who is and will not be under the influence of politics and who will be able to resist any kind of pressure, said the SDA in a statement.

The party claims that they will not accept the fact that, as a rule, the HJPC has generally preferred to appoint anyone but Bosniaks to the leading positions in the judicial institutions during the ongoing mandate of the HJPC.

In addition to endangering the national balance, which is a constitutional and legal obligation, this is also a kind of ethnic purification of these institutions by removing Bosniaks from all of the executive positions which undermines the trust in the complete judiciary system, the SDA points out.

The SDA also raises the question of whether Bosniaks have been removed from the leading positions in the judiciary so that a campaign can be carried out in which high-ranking officers and soldiers of the Army of the RBiH are indicted at all cost, all with the attempt to create fictitious ethnic balance in the processing of war crimes?

The SDA warns that the HJPC also has avoided filing indictments and prosecuting officers of armed formations that carried out aggression against BiH, although the crimes they committed were systematic, organized and on a mass scale.

“We are also witnesses that the judiciary, which is obviously influenced by certain political circles, has avoided to apprehend those responsible for large scale corruption, but also the judiciary is also avoiding to tackle the crimes related to direct and public attacks on the BiH constitutional order,” underlined the SDA.
