Search for the missing – Sanction those who do not report mass graves locations

SARAJEVO, May 16 (FENA) - At the expert seminar "Searching for locations of graves and exhumations as evidence material", it was concluded that the process of searching for missing persons in BiH has entered the most difficult phase, and that all resources must be put at disposal to the investigators, so that this process would be brought to an end.

The seminar, which was held in Jahorina under the auspices of the UNDP and the Embassy of the United Kingdom, was attended by SIPA investigators, representatives of the Institute for Missing Persons of BiH (INO), the Prosecutor's Office of BiH, representatives of the ICRC and ICMP, and was opened by Gordana Tadić , Chief Prosecutor of the Prosecutor's Office of BiH, who spoke about the importance of searching for missing persons in the processing of war crimes processing.

At the beginning of the seminar, it was pointed out that BiH is still searching for 7,200 missing persons in the territory of the entire country.

Nikola Perišić, Chair of the Collegium of the Directors of the Institute for Missing Persons of BiH (INOBiH), explained that the problem is the lack of relevant information on the locations of the graves.

“The sources of information available so far, that is, the witnesses, the Hague Tribunal archives, the satellite images with which the graves were located have all been exhausted. The problem is material and technical equipment. We do not have geo-radars, geo-probes and drones, or specially trained dogs, which would be of great help to us,” said Perišić.

After a two-day exchange of experiences of investigators working on this topic, the conclusions were adopted who application would better facilitate the process of finding missing persons.

One of them is the obligation to apply the provision of the BiH Criminal Code, which refers to the sanctioning of those who know where mass graves are and still chose not to report it.

The punishment foreseen in the case of the commission of this criminal offense is three years in prison.

It was also concluded that the INOBiH investigators must have access to the database of the Ministry of Defense of BiH and the Archives of the Court in The Hague.

At the level of institutions involved in the process of searching for missing persons, a technical support department should be established to gather all the material and technical means that would enable investigators to more effectively search the terrain when they have information about the location of graves.

Seminar participants agreed that the flow of information between institutions involved in the search for missing persons must be better and that the state and non-governmental sector should be encouraged to get involved in this process.
