Jukić: BiH Presidency should react to interference in the work of the judiciary

SARAJEVO, June 10 (FENA) - Vice President of the High Judicial and Prosecutorial Council (HJPC) Ružić Jukić has urged the members of the Presidency of Bosnia and Herzegovina to react urgently because, as she said, “the interference of representatives of the international community in BiH in the work of the judiciary.”

As she pointed out in the letter, she requests that the Presidency informs the United Nations (UN) and the European Union (EU) about the interference in the work of the judicial institutions of the High Representative Valentin Inzko, Head of the OSCE Mission to BiH, and ambassadors of the United States of America, the Federal Republic of Germany, the Kingdom of the Netherlands and the Kingdom of Spain.

“HR Inzko, representatives of the embassies and Head of the OSCE Mission, made statements directly violating the independence of the judicial system and have stepped out of the framework of the competencies they have within their duties in BiH,” Jukić said.

She believes that, “by accusing the First Instance Disciplinary Commission of the HJPC and by asking the Second Instance Commission to make a different disciplinary decision, they intervened in the rendering of a final decision of this judicial institution in the harshest manner.”

Such interference in the work of the judiciary, Jukić adds, would not be controversial if it was for the purpose of harmonizing the Rules of the HJPC with the European acquis, because Chapters 23 "Judiciary and Human Rights" and "Justice, Freedom and Security" are key areas in the negotiations with the EU.

“But no one has the right, and especially the foreign embassies, to interfere in the work of judicial institutions by exerting pressure on what kind of decision would be made in court proceedings, investigations or disciplinary proceedings,” Jukić underlined in a letter to members of the BiH Presidency.

She also noted that this would not be possible in the countries from which the representatives of the international community come from, “because the judicial system in these countries is protected from such attacks, which lead to anarchy and total distrust of citizens in the judicial system.”

She finally underlined that the Council accepted all the recommendations of the European Commission regarding the changes to the HJPC Rules, but expressed opinion that they are now in a position to be ineffective in the election of the holders of judicial functions because they could not appoint the staff under the old rules.
