Grubeša: We must strive towards respecting expertise rather than politics

SARAJEVO, August 5 (FENA) - The BiH Justice Minister Josip Grubeša told reporters after a session of the BiH Council of Ministers that they discussed the conclusions of the House of Representatives of the BiH Parliamentary Assembly regarding the work of the judicial institutions and that they referred the most to the work of the High Judicial and the Prosecutorial Council (HJPC).

“We have heard in parliament that the Ministry of Justice should be the one to send the new draft law on HJPC into the parliamentary procedure. I think that the Ministry of Justice should not be alone in this process, and that we should not be the only ones working on the new law on HJPC, but that we need a broad coalition from all levels and all institutions,” said Grubeša.

He added that, after everyone submits their opinions, only then a complete draft law could be referred into further procedure.

Grubeša said that it is the responsibility of the BiH Ministry of Justice to continue with the activities it has previously undertaken and that these activities concern the formation of a working group.

“We had a meeting of justice ministers where we agreed to continue with the reforms regarding the judiciary system. Representatives from RS did not show up to the meeting of the working group, but we found a model on how to unblock the process so that experts at the highest level would have a discussion, that is, they would make decisions on proposals/amendments to the HJPC Law,” explained Grubeša. 

He noted that all initiatives and proposals submitted to the working group would be equally considered.

Discussing the Revised War Crimes Processing Strategy, he said that although it was supported by all participants who worked on its elaboration and by the international community, it was not adopted at the BiH Council of Ministers.

“It is my opinion that the strategy should be adopted, because it does not deal with individual cases, but it does unburden the Prosecutor's Office of BiH, i.e., it allocates the cases in order to reach the final goal, to reduce the backlog of war crimes cases,” said the BiH Minister of Justice.

He emphasized that “we in BiH should strive towards respecting the profession and experts rather than politicians”.  

“I hope and expect that the strategy will be on the agenda as soon as possible and that it would be adopted,” concluded Minister Grubeša.
