Judgment upheld in Saša Cvetković case for war crime

SARAJEVO, November 14 (FENA) - The Appellate Division Panel of the Court of Bosnia and Herzegovina handed down an appeals judgment in the case of Saša Cvetković, refusing as ill-founded the appeals filed by defense counsel for the accused Saša Cvetković and the victim’s authorized representative, and upholding the judgment delivered by the Court of BiH on 22 March 2019.

The trial judgment of the Court of BiH of 22 March 2019 found the accused Saša Cvetković guilty of the criminal offense War Crimes against Civilians under Article 142(1) CC SFRY and sentenced him to 12 (twelve) years of imprisonment.

Pursuant to Article 198(2) of the CPC BiH, as read with Articles 200 and 202 of the Law of Obligations, the victim’s redress claim was partly granted, so the accused Saša Cvetković is under the obligation to pay the victim 15,000.00 KM for the suffered fear and mental pain; 5,000.00 KM for the violation of freedom, dignity, moral and personal rights; 10,000.00 KM for mental pain due to diminished general abilities of 25%, plus a default interest on these amounts starting from the day of adjudication to the day of payment within 30 days of the date when the judgment becomes final, under the threat of enforcement.

The victim is referred to pursue her redress claim in civil proceedings through the amount of the adjudicated non-material damage compensation, stated the BiH Court.
