War crime indictments filed against nine members of the 108th Brčko Brigade

SARAJEVO, December 31 (FENA) - Prosecutor of the Special Department for War Crimes has filed indictments against Admir Rizvanović, Smajil Omerović, Jasmin Huskanović, Kemal Hindić, Martin Frančešević, Ramiz Pljakić, Ivo Anđelović, Hazim Fazlović, and Bahrija Fazlović.

A total of nine accused, former members of the Army of the Republic of BiH and the Croat Defense Council (HVO) from the Brčko area, have been charged with torturing, abusing and killing 11 captured members of the Army of Republika Srpska (VRS).

The Accused Rizvanović, Omerović and Huskanović are charged with having acted contrary to the provisions of international humanitarian law and the Geneva Conventions governing the treatment of prisoners of war during armed conflict as members of the Intervention Unit of the 3rd Battalion of the 108th Motorized Brigade of the Army of the RBiH.

They are charged with having captured 11 members of the 1st Posavina Brigade of the VRS during the operations near the Boderište site, ambushed, tortured and ill-treated them, inflicted grievous bodily harm on them, and subsequently killed them using fire and cold weapons, inflicting life-threatening and postmortem injuries on them.

The accused Hindić, Frančešević, Pljakić, Fazlović, Anđelović and Fazlović are charged with being aware of the crime committed by subordinate soldiers in their capacity as Commanders of Operational Group I- Bosanska Posavina, 108th HVO Infantry Brigade, and 108th Motorized Brigade of the Army of the RBiH , and failed to take the necessary and reasonable steps to ensure that the perpetrators were located, prosecuted and punished for war crimes.

The accused are charged with the criminal offense of war crimes against prisoners of war.

The Prosecution of Bosnia and Herzegovina intends to prove the allegations by calling about 70 witnesses and expert witnesses and attaching more than 300 pieces of material evidence, the BiH Prosecutor's Office said.
