BANJA LUKA, January 21 (FENA) - Retailers in the entity of Republika Srpska are not allowed to charge customers for bags containing their trademark, any trademark or a logo of a company, or colors that may be associated with the said retailer, the entity inspectorate warned today.
In connection to the information that, as of January 1 this year, most retail outlets started charging their customers for plastic bags, the Trade Inspectorate reminded that the Consumer Protection Act stipulates that wrappings, such as bags, paper, special paper or similar items, used to carry purchased products bearing in whole or in part the logo, sign, slogan and/or name of the producer/retailer/ dealer, is considered to be advertising means that the merchant must not separately charge the buyer.
Retail outlets are allowed to sell bags without the manufacturer's or retailer advertising labels, without logos, signs, slogans and the like as any other commodity.
They have to be priced through calculations and must be in the business documents. It is also necessary to issue a receipt for them as for any other goods,” emphasized the RS Trade Inspectorate.
If a retailer acts contrary to the provisions of the law, a fine of 1,000 KM to 5,000 KM will be issued, and for the responsible person and the owner/entrepreneur, a fine of 500 KM to 2,500 KM.
