Salkić: We need to examine the constitutionality of the Law on Holidays in RS

BANJA LUKA, February 10 (FENA) - The entity of Republika Srpska Vice-President Ramiz Salkić believes it is necessary to re-analyze the Law on Holidays in that entity, as well as the provision that the entity government may, by its decision, declare a non-working day.

“The entity government regularly abuses this provision every year and proclaims a non-working day to mark the New Year according to the Julian calendar, which discriminates against Bosniak Muslims and Croat Catholics,” Salkić told FENA.

Also, this year, he reminds, the RS government has declared a non-working day on January 9, which the Constitutional Court of Bosnia and Herzegovina declared as unconstitutional to be marked as the day of this entity.

“The government, by its decision, i.e., the Ministry of Education and Culture, imposed the celebration of Patron of Saint Sava's Day in schools, which is also a discriminatory provision against Muslims, Catholics, and all other non-Orthodox citizens,” said Salkić.

He also considers it necessary to seek an assessment of the compliance of laws enacted by the entity parliament in the previous period with Article 97 of the RS Constitution, which provides for representation under the 1991 census, which is not recognized by the existing laws in the manner prescribed by the Constitution, and it is yet another source of discrimination.

The fact that, as he says, the Constitutional Court of Bosnia and Herzegovina by its decision repealed certain provisions of the law on inland navigation and the Law on Agricultural Land of the entity of RS shows that the entity government and the National Assembly tends to adopt certain laws contrary to the Constitution of Bosnia and Herzegovina and laws that discriminate against citizens.

“I believe that there is a basis and space for filing additional proceedings before the Constitutional Court of Bosnia and Herzegovina on the assessment of the conformity of the Constitution of the entity of RS with the Constitution of Bosnia and Herzegovina, as well as a number of laws adopted in the RS National Assembly,” said Salkić.

Hr emphasizes that a comprehensive analysis of laws and regulations is needed from those who are able to bring proceedings before the Constitutional Court of Bosnia and Herzegovina, in order to improve the constitutional and legislative position of all the non-Serb population in that entity.

“The Constitutional Court of Bosnia and Herzegovina is the institution to address everything that the current government in the RS imposes and which is a source of discrimination in different spheres of life,” said Salkić.
