Komšić: We will not allow blockade of the appointment of judges to BiH CC

SARAJEVO, February 19 (FENA) - Chairman of the Presidency of Bosnia and Herzegovina, Željko Komšić reiterated to reporters today that it is the right of the President of the European Court of Human Rights to elect three international judges to the BiH Constitutional Court, adding that giving opinions and consultations is not binding or an obligation of the Presidency.

The BiH Presidency member Milorad Dodik requested that the Presidency consider the appointment of a new foreign judge at today's session because he claims that Komšić did not make that proposal available to him, but Komšić points out that Dodik's attempt is to completely prevent the appointment of the judges to the Constitutional Court of BiH through the procedures he interprets in a way that suit him alone and that he will not be allowed to do so,” Komšić stressed.

“If he thinks that we are naive here and if he thinks that by using force and actions contrary to the Constitution and the laws, he will manage to prevent the appointment of foreign judges to the Constitutional Court and rid the Constitutional Court of foreign judges, then he is utterly mistaken,” said Komšić.

Still, he says that he understands Dodik’s behavior because he comes from the part of BiH where his word is the law and the first and last, and he has gotten used to it,” says Komšić, but he also has to get used to reading the documents and coming to work.

Komšić stresses that he cannot be held accountable for the irresponsible behavior of his advisors and for the things they have missed out, as he had several occasions and chances to react, but there were obvious shortcomings.

Chairman of the BiH Presidency points out that if Dodik thinks that something was done unconstitutionally, he should appeal to the Constitutional Court because that institution has the power to determine if that is what had happened.

He said that Dodik could propose amendments to the BiH Constitution, but the question is what would be the opinion of the BiH Parliament on that issue.

Asked by reporters about Dodik's behavior at the session, given that the Presidency unanimously decided not to pardon the two persons proposed to them, Komšić says it is a fact that Dodik came to the session and voted regardless of what he announced earlier in the RSNA that he would not participate in decision-making about anything at the state level.

Asked about Dodik's announcement that he would not support the decision on the extension of Interim  Financing of the BiH institutions,  Komšić reminded that the Presidency does not decide on this, and if the representatives of his party decide not to support that decision in the BiH Council of Ministers, then they must take full responsibility for it.
