BiH PA HoR rejects a number of opinions of Constitutional Committee

SARAJEVO, June 10 (FENA) - The House of Representatives of the BiH Parliamentary Assembly today considered a proposal of Amendment II to the BiH Constitution, proposed by MPs Predrag Kojović, Mirjana Marinković-Lepić, Aida Baručija and Damir Arnaut, with a negative opinion of the Constitutional Committee.

The House decided not to accept the Committee's opinion but to send back the proposed amendments for reconsideration and to draw up a new report.

The deputies also discussed the Proposal of Amendment II and Amendment III to the Constitution of BiH, proposed by MP Dženan Đonlagić, with the Opinion of the Constitutional Committee, which has rejected the proposed amendments on two occasions.

The Committee's opinion was rejected, and in accordance with the procedure, after two negative reports from the Committee, the legislative procedure for the proposed amendments has been suspended.

Dženan Đonlagić, an MP of the Democratic Front, explaining the proposed solutions, said that it was a proposal of amendments to the Constitution of BiH that eliminate the systemic discrimination contained in the Constitution of BiH.

“The aim of this proposed amendment to the Constitution was to eliminate the systemic discrimination singled out by the European Court of Human Rights in its judgments, that would be the basis for changes to the BiH Constitution, which would then create preconditions for changes to the BiH Election Law,” Đonlagić explained.

The draft law on amendments to the BiH Criminal Procedure Code, proposed by MPs Saša Magazinović, Jasmin Emrić and Šemsudin Mehmedović, was returned to the Constitutional Committee for reconsideration after the deputies did not accept the committee's negative opinion on the proposed bill.

The draft law amending the Law on Excise Tax in Bosnia and Herzegovina, proposed by the BiH Council of Ministers, was rejected because the deputies accepted the negative opinion of the Finance and Budget Committee on the proposed law.

The deputies rejected the negative opinion of the Constitutional Committee on the Proposal of the Law on Amendments to the Law on Excise Tax in BiH, which was proposed by MP Aid Baručija, and the law was returned to the committee to reconsider it and draft a new opinion.

The MPs, under an urgent procedure, adopted the Draft Law on Mandatory Contributions of Officials in the Institutions of Bosnia and Herzegovina for the fight against the COVID-19 pandemic, whose proponents are the deputies: Predrag Kojović, Mirjana Marinković-Lepić, Aida Baručija and Damir Arnaut.

This proposal envisages the obligatory contribution of officials in the fight against the coronavirus pandemic, in such a way that during this year, 20 percent of their net salary will be allocated to a special fund for the fight against the coronavirus pandemic.

The Draft Law on Amendments to the Law on Salaries and Remunerations in the BiH Institutions, proposed by MPs Mirjana Marinković-Lepić and Predrag Kojović, was also adopted.

After the negative opinion of the Constitutional Committee was rejected, the Draft Law on the Election of Judges of the Constitutional Court of BiH, previously appointed by the President of the European Court of Human Rights, proposed by: Nebojša Radmanović, Snježana Novaković-Bursač, Nenad Stevandić, Nenad Nešić, Jakov Galić, Obren Petrović, Dragan Bogdanić, Sanja Vulić, Ljubica Miljanović, Borjana Krišto, Nikola Lovrinović, Mijo Matanović, Predrag Kožul and Darijana Filipović were returned to the committee to reconsider it and draft a new opinion.
