SDA: RS Council of Peoples must have same powers as FBiH House of Peoples

SARAJEVO, June 16 (FENA) - The Party of Democratic Action (SDA) believes that the call of BiH Presidency member Milorad Dodik to reduce the powers of the RS Council of Peoples is a political adventure that could lead to disruption of relations established by the Dayton Peace Agreement.

The SDA statement said that the current RS Council of Peoples was not in line with the BiH Constitution, "but not because it has strong position, as Dodik claims, but quite the opposite - because it has a weaker position than the FBiH House of Peoples which unlike the RS Council of Peoples, it can block everything, even the election of an entity government, as is currently the case."

“According to the Dayton Constitution, all constituent peoples have equal rights on the entire territory of Bosnia and Herzegovina, which was confirmed by the Constitutional Court in the decision from 2000. This means that all the rights that the constituent peoples have in the Federation of BiH must have in the entity of RS, as well as in the Brčko District,” the SDA said.

It is stated that "the fact that these rights are significantly greater in the Federation of BiH and Brčko District than in the RS entity, which is a consequence of incomplete and asymmetric implementation of the Decision on the constituency of the people.

As long as the House of Peoples of FBiH has the powers it currently has, the Council of Peoples of RS can only strengthen its position, because any solution must be based on the Constitution of BiH, which is above the entity constitutions, SDA said in a statement.
