Džaferović: Belgrade Court's verdict in case of Husein Mujanović is scandalous

SARAJEVO, July 6 (FENA) - Chairman of the Presidency of Bosnia and Herzegovina Šefik Džaferović called today's first-instance verdict of the High Court in Belgrade, by which Husein Mujanović was sentenced to ten years in prison, scandalous.

“It is to be condemned that the Serbian judiciary conducts criminal proceedings for alleged war crimes against members of the Army of the Republic of BiH. The judiciary of the Republic of Serbia, which carried out the aggression against BiH, and those are the facts established by the International Court of Justice, as well as The Hague Tribunal in several of its decisions, prosecutes those who defended BiH in a situation where there is a Court of BiH competent for such cases," Džaferović pointed out in a statement for FENA.

BiH Presidency Chairman considers that this is a complete abuse of international law by Serbia, as the state that carried out the aggression is trying to prosecute those who defended BiH from that aggression for war crimes before its judiciary.

“This does not exist anywhere in the world and this is a practice that has lasted for many years. Let us remember the issuance of international arrest warrants against BiH defenders who found themselves in third countries. All those countries have made decisions that the procedures are led by the Court of BiH,” he said.

He also mentioned that currently two people, entering Serbia, have been arrested and proceedings are being conducted against them, and BiH has submitted a request for the transfer of the case and extradition three times, and all that has been rejected by the Serbian judiciary.

“This is a situation that is contrary to international law and the institutions in charge of applying international law will have to deal with this issue. That issue must be resolved,” Džaferović believes.

He called on Serbia to take this situation seriously and to extradite them to BiH in order for BiH to conduct, if necessary, procedures, because otherwise it will further complicate mutual relations.

“It is a question of attitude towards the past. Serbia must face the facts and its own past, but also the terrible mistakes of the Milošević regime, the fact that aggression was committed against BiH and that is the only way we can move forward,” concluded Chairman of the Presidency of BiH, Šefik Džaferović.
