Institute of house arrest with electronic surveillance enabled in FBiH CPC

SARAJEVO, October 1 (FENA) - Custody with electronic surveillance has been introduced as a new institute in the criminal legislation of the Federation of BiH, confirmed today the FBiH Minister of Justice Mato Jozić in a statement for FENA, stating that electronic custody with electronic surveillance was passed in the House of Peoples, and earlier in the House of Representatives of the Parliament of the Federation of BiH with the adopted amendments to the Criminal Procedure Code.

It shall enter into force on the day following the day of its publication in the Official Gazette of the Federation of BiH.

"The mentioned amendment leaves the possibility for the courts and prosecutor's offices to order electronic surveillance during the criminal proceedings against the suspects or the accused," said Jozić.

The cantons now have a chance to reduce the cost of detention by applying this institute.

In addition to the aforementioned amendments to the Criminal Procedure Code, amendments have been made in accordance with the judgment of the Constitutional Court of BiH, and, among other things, criminal offenses have also been singled out for which special investigative actions and their longest duration is determined.

The amendments to the Law prescribe the right of a witness not to answer certain questions when it is probable that the answer to those questions would expose him to criminal prosecution and the possibility to answer those questions if the competent chief prosecutor declares in writing that they would not prosecute the witness.
