CoE: Maintaining existing electoral system in BiH violates European Convention

STRASBOURG/SARAJEVO, October 2 (FENA) - The Committee of Ministers, the body of the Council of Europe in charge of supervision of the execution of the judgments of the European Court of Human Rights, reiterated its concern that the authorities and political leaders of Bosnia and Herzegovina have not yet reached a consensus on the content of the required amendments to be introduced in the Constitution of Bosnia and Herzegovina.

The deputies of the Committee recalled that the retention of the present discriminatory election system constitutes a clear violation of the requirements of the European Convention on Human Rights and a manifest breach of Bosnia and Herzegovina’s unconditional obligation under Article 46 of the Convention, and thus also of its undertakings as a member State of the Council of Europe.

They noted with interest the conclusion of 28 April 2020 by the Presidency of Bosnia and Herzegovina setting up a high level ad hoc political task force and tasking the Council of Ministers of Bosnia and Herzegovina to prepare an action plan, inter alia, for the present execution process.

They welcomed the political agreement reached between the Bosniak and Croat political leaders on 17 June 2020 to start negotiations on the implementation of the present judgments and to agree on draft constitutional and legislative amendments within six months with a view to ensuring their adoption in Parliament before end 2021.

The deputies invited the authorities to rapidly provide further detailed information on the follow-up to the above developments as well as the calendar for the implementation of the envisaged activities.

The Committee noted further with interest the continuation of the Human Rights Trust Fund project aiming at facilitating the reform process, encouraged again the authorities to reinforce their cooperation with the Council of Europe, the Secretariat and the Venice Commission with a view to ensuring the adoption of the necessary constitutional and other reforms in time before the 2022 elections. 

The Committee of Ministers highlighted the importance of seizing the momentum to ensure that the necessary steps are taken rapidly to adopt the necessary amendments before the end of 2021.
